JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 03-03-2015 The petitioner is in custody since 17.07.2014 in relation to Bahadurpur P.S. Case No. 221/2014 (G.R. No. 2326/2014) instituted under Section 392 of the Indian Penal Code. It is alleged that some persons entered in the house of the informant and took away household articles. On hulla being raised by the informant, villagers assembled and in the process of being chased, the miscreants left behind a motorcycle. Subsequently, two persons came on a Scooty to take back the motorcycle, but they were apprehended, one of whom is the petitioner. Scooty is registered in the name of the father of the petitioner. Petitioner is said to be a student of the University. Upon search, certain medicines were found in the dickey of the Scooty. Learned counsel for the petitioner states that the other person arrested was granted bail, but the petitioner, who had gone

Patna High Court Cr.Misc. No.47144 of 2014 (2) dt.03-03-2015 to buy medicines and while he was returning his home, over zealous villagers caught hold of him and beaten him, is languishing in jail.

Be that as it may, the petitioner, namely, Abhimanyu Singh @ Abhimannu Singh shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Bahadurpur P.S. Case No. 221/2014 (G.R. No. 2326/2014), subject to condition that petitioner would be present in the Court on every date fixed and if on any two consecutive dates petitioner is found to be absent, the trial court would be at liberty to cancel his bail.
