The petitioner seeks bail in anticipation of his arrest in connection with Motihari Muffasil P.S. Case No. 329 of 2019 instituted for the offences under Section 457 and 380 of the Indian Penal Code.

A theft was committed in the house of the informant, who reportedly stays at Bikaner in the State of Rajasthan. The petitioner is said to have visited the house along with one Amitabh Kumar, a reputed doctor. The petitioner is one of the medical agents, who had visited the

Patna High Court CR. MISC. No.32526 of 2020(2) dt.19-02-2021 2/2 house for the purposes of having a look at the house, which Mr. Amitabh Kumar wanted to take on rent. The accusation against the petitioner is only on the basis of suspicion without any basis.

Considering the nature of accusation against the petitioner, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Motihari Muffasil P.S. Case No. 329 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
