JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was police official at the relevant time and it is alleged that he was caught red handed while taking bribe of Rs.5,000/- but submission on behalf of the petitioner is that the allegation maker is accused in a criminal case and, as a matter of fact, petitioner being I.O. of that case had given notice to allegation maker to deposit his arms and its licence for examination, which caused annoyance to allegation maker, who with the help of officials of vigilance hatched conspiracy and got him trapped in this false case. Moreover, investigation against the petitioner has already been completed.

Patna High Court Cr.Misc. No.29919 of 2016 (2) dt.04-08-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance North Bihar, Muzaffarpur in connection with Special Case No. 19 of 2016 arising out of Vigilance P.S.Case No. 42 of 2016.
