ANJANA MISHRA ORAL ORDER 23-05-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Ujiyarpur P.S. Excise Case No.107 of 2019 for allegedly having committed the offence Section 30(a) of the Bihar Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the alleged recovery was not from the conscious possession of the petitioner but from the Goshala of the petitioner. Considering the fact that the alleged recovery was not from the conscious possession of the petitioner and also that the petitioner has got no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the

Excise Case No.107 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
