2. The petitioner, happens to be husband of the informant, apprehending his arrest in connection with G.R. No. 07559 of 2025, corresponding to Sonepur P.S. Case No. 759 of 2025, registered for the offences punishable under Sections 126(2), 115(2), 85, 352, 351(2) and 3(5) of the B.N.S.

3. At the outset, learned Advocate for the State drawing the attention of this Court to the impugned order submitted that since the prayer of the petitioner for grant of anticipatory bail came to be rejected on account of nonprosecution, the present application is not maintainable.

4. Learned Advocate for the petitioner submitted that

Patna High Court CR. MISC. No.36281 of 2026(2) dt.02-06-2026 2/2 since the mediation between the husband and wife did not get any fruit, therefore, the petitioner did not appear on the next date, which resulted into dismissal on account of nonprosecution.

5. Be that as it may, considering the fact that the anticipatory bail filed by the petitioner came to be rejected by the learned Sessions Judge, Saran on account of nonprosecution, we do not find any reason or occasion to entertain the present application.

6. The petitioner is at liberty to file a fresh bail application before the learned Sessions Judge, Saran at Chapra.

7. With the aforesaid observation and liberty, the present anticipatory bail application stands disposed off. (Harish Kumar, J) shivank/- U T
