JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2015 Petitioner is languishing in custody since 24.01.2015 in a case registered for the offences punishable under Sections 307, 323, 324, 341, 354, 379, 504/34 of the I.P.C and Sections 3(1)(x)(xi) of the SC & ST (Prevention of Atrocities) Act.

It is alleged that petitioner was showing obscene video to the daughter of the informant which was objected by the informant when the petitioner abused the informant by calling caste name. Thereafter this petitioner came and started dragging the daughter of the informant and when the informant and his son came to rescue then they were also assaulted by co-accused Md. Habid and Madhina Khatoon. It is submitted by learned counsel for the petitioner that there is no injury report on record and there is counter version of the occurrence also. A statement to that

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Siwaipatti P.S. Case No. 07 of 2015.
