The petitioner seeks bail in Naugachia .P.S. Case No. 82/2014 registered for the offence under Sections 376, 420, and other sections of the Indian Penal Code.

The informant alleged in her complaint petition that the petitioner established physical relation with her on the pretext of providing her job. The petitioner also took money from the informant for the same purpose.

It is submitted that the entire allegation is false and concocted. She earlier filed informatory petition 935 of 2015 against Deepak Patel and others. The prosecutrix is a married lady. The petitioner is in jail for about nine moths. The learned A.P.P.

while opposing the prayer for bail

Patna High Court Cr.Misc. No.47439 of 2014 (3) dt.20-03-2015 2/2 submitted, that the prosecutrix became pregnant. It appears that the prosecutrix is a married woman and physical relation with petitioner is consensual. Considering the facts aforesaid and the fact that the petitioner is in jail for more than nine months, he is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Chief Judicial Magistrate, Naugachia in connection with Naugachia P.S.
