JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in jail since 29.05.2014 in a case registered under Section 414 of the I.P.C. and Sections 20,22,23 and 25 of the Narcotic Drugs and Psychotropic Substances Act. 450 Kgs. Ganja was recovered from the truck bearing registration no. HR-55 N-3221 and the petitioner and one Narendra Singh @ Nagendra Singh were arrested from a Scorpio and admittedly, nothing was recovered from the said Scorpio. Though, the driver of the truck disclosed that the seized Ganja belonged to the petitioner and the above stated Narendra Singh @ Nagendra Singh but F.I.R. reflects that the petitioner was driver of

Patna High Court Cr.Misc. No.7042 of 2015 (3) dt.29-04-2015 2 / 2 the said Scorpio and admittedly, co-accused Narendra Singh @ Nagendra Singh has already been granted privilege of bail by a coordinate Bench of this Court vide order dated 18.09.2014 passed in Cr. Misc. No. 31765 of 2014.

Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, East Champaran at Motihari, in connection with N.D.P.S. Case No. 38 of 2014, arising out of Mehsi P.S. Case No. 83 of 2014, subject to the condition that one of the sureties shall be close relative of the petitioner who shall swear affidavit to this effect as to how he is related with the petitioner and further more, another sureties must be a local and holder of landed property.
