JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in custody since 25.3.2016 for the offences punishable under Section 396 of the Indian Penal Code and Sections 3⁄4 of Explosive Substance Act.

The name of petitioner surfaced in this case in confessional statement of co-accused Idrish Nut. From perusal of the impugned order, I find that except the aforesaid confessional statement, there is nothing against the petitioner who does not have any criminal antecedents. Moreover, co-accused Idrish Nut and several others have already been granted privilege of bail by the Bench of this Court, which is apparent from Annexures 2, 3, 3/1, 3/2 and 3/3.

Accordingly, the petitioner above named, is directed

Patna High Court Cr.Misc. No.29872 of 2016 (2) dt.28-07-2016 2/2 to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi, in connection with Nanpur P.S. Case No. 06 of 2014.
