Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with Bidupur P.S. Case No. 166 of 2021 registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The petitioners are father, mother and sister-in-law of the deceased.

No.42781 of 2021(3) dt.25-03-2022 2/2 The F.I.R. has been registered on the basis of the statement of a local Chaukidar who has suspected the petitioners to be involved in the crime. During investigation, no evidence has come to connect the petitioners in the crime. It is improbable that the petitioners who are father, mother and sister-in-law of the deceased will be involved in the killing of the deceased. Moreover there is no chance of petitioners' absconding.

Considering the facts and circumstances, the present anticipatory bail application is allowed.

Accordingly, let the petitioners, above named, be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Bidupur P.S. Case No. 166 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Sandeep Kumar, J) Saif/- U T
