The petitioner is apprehending his arrest in connection with Bidupur P.S. Case No.134 of 2018 registered for offences punishable under Section 30(a) of Bihar Excise Act. Allegation against the petitioner is that 97 litres of illicit liquor was recovered from the vehicle of the petitioner who is said to be the owner of the vehicle.

Submission of learned counsel for the petitioner is that vehicle was driving by the driver and he has no knowledge about the carrying of liquor in the said vehicle. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the Court

Patna High Court Cr.Misc. No.1760 of 2019(2) dt.01-02-2019 2/2 below within a period of six weeks from the date of receipt/ production of a copy of this order, be released on bail upon furnishing bail bond of Rs.25,000/-(Rupees Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge IInd-cumSpecial Judge, Vaishali at Hajipur in connection with Bidupur P.S. Case No.134 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with further condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
