The matter has been taken up through video conferencing.
The petitioner seeks bail in Hajipur Town P.S. case No. 930/2019 registered u/s 353, 307, 34 of the IPC and u/s 25(1-b) a, 26, 27 of Arms Act.
The informant, a police officer, alleged that Daulat Kumar, a Constable, was returning to his house at night but two criminals on a black motor cycle came and snatched the mobile and purse of Daulat Kumar at the point of pistol. While the police was inquiring, Daulat Kumar disclosed that two persons came on a motor cycle bearing registration No. BR01A-0653 and snatched his belongings. On the basis of location of mobile raid was conducted and two persons, namely, Chandan Kumar,
Patna High Court CR. MISC. No.33326 of 2020(2) dt.15-12-2020 2/2 the petitioner, and Chhotu were apprehended. From possession of the petitioner one country made pistol was recovered. The learned counsel for the petitioner submits that no looted article was recovered from the possession of the petitioner. The petitioner did not rob Daulat Kumar, the Constable. Chhotu has already been granted bail. The petitioner is in custody for about one year and two months. Taking into consideration the facts aforesaid and the fact that petitioner has remained in jail for about one year and two months, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. case No. 930/2019.
