JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 124(A), 307, 120(B) of the Indian Penal Code, Section 3⁄4 of Explosive Substance Act and Section 17 of C.L.A. Act.

One Ganesh Yadav was caught by the police and the said Ganesh Yadav disclosed the name of several persons including the petitioner and according to aforesaid disclosure, petitioner happens to be driver of JCB Machine. Moreover, the extremists, namely, Sandipjee and Prasadjee pressurized the petitioner and others to plant bomb inside the road. Learned counsel for the petitioner points out that co-

No.33887 of 2016 (2) dt.18-08-2016 2/2 accused, Kaushal Singh and Nagdeo Yadav, having more or less similar allegation, have already been granted privilege of bail by a co-ordinate Bench of this Court whereas petitioner is in jail custody since 11.04.2016 without having any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 42 of 2016.
