2. The petitioner seeks regular bail in connection with Kamtaul P.S. Case No. 143 of 2024 registered for the offence under Sections 341, 342, 376, 323, 504, 506, 354(B) read with Section 34 of the Indian Penal Code and Section 8 of the POCSO Act.

3. The allegation against the petitioner is that he along with other co-accused caught the victim and took her away in a garden and Kishan Kumar (Petitioner) and the other co-accused forcibly committed rape with the victim on the point of knife. The petitioner is in custody since 15.04.2025.

4. The victim girl in her statement recorded under Section 164 Cr.P.C., has supported the commission of rape upon her by the accused persons including the petitioner.

5. There is direct and specific allegation against the petitioner that he was present at the spot and had actively participated in the commission of the crime.

6. Considering the nature of the accusation and the gravity of the offence, this Court is not inclined to grant regular bail to the petitioner.

7. Accordingly, this application for regular bail stands rejected.
