JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This is an application for grant of anticipatory bail in connection with Kajra P.S. Case No. 44 of 2018, disclosing offences under Sections 147, 148, 149, 341, 337, 338, 504, 353, 435 of the Indian Penal Code.
Allegation against the petitioners and several other accused persons is of creating road blockage and disrupting the traffic.
Submission of learned counsel for the petitioners is that though they are named in the F.I.R., but no specific allegation has been attributed against them. They have no criminal antecedent, except petitioner no.3, who is accused in one more case.
Patna High Court Cr.Misc. No.1391 of 2019(2) dt.22-01-2019 2/2 Heard learned A.P.P. also.
Having heard both sides, considering the above submission, so far petitioner no.3 is concerned, I am not inclined to grant anticipatory bail to him, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court.
So far petitioner nos. 1, 2, 4 and 5 are concerned, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Lakhisarai, in connection with Kajra P.S. Case No. 44 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. With the above observation, this application is disposed of.
