Petitioner seeks bail in a case registered under sections 302, 120B/34 of the Indian Penal Code and 27 of the Arms Act. Petitioner is not named in the first information report but in course of investigation, witnesses claimed to have seen the culprits coming out from the brick-kiln of the petitioner. Witnesses also stated that it is the petitioner who hired the criminal for committing murder of the deceased.

Subsequently, one Shyam Sunder Singh was arrested in connection with another case and made his confessional statement disclosing this fact that this petitioner had hired him and others for committing murder of the deceased. Except the aforesaid material, there appears to be nothing against the petitioner. Investigation against

Patna High Court Cr.Misc. No.24061 of 2016 (3) dt.18-07-2016 the petitioner has already been completed.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Sitamarhi in Sahiyara P.S. Case no. 145/2015. shahid (Hemant Kumar Srivastava,J) U T
