The petitioner is languishing in custody since 02.01.2015 in a case registered for the offences punishable under Sections 147, 148, 149, 224, 225, 353, 384, 386, 504 and 506 of the Indian Penal Code.

It is alleged that Mantu Yadav was arrested by the police when accused persons including the petitioner got him released.

It is submitted by learned counsel for the petitioner that the accusation is omnibus and general. Though, the petitioner has serious criminal antecedent but co-accused Om Prakash Yadav having similar criminal antecedent has been

Patna High Court Cr.Misc. No.13173 of 2015 (02) dt.07-04-2015 2/2 granted bail vide Cr. Misc. No. 38550 of 2014 and the investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jhanjharpur, District - Madhubani in connection with Phulparas P.S. Case No. 30 of 2014.

Considering the criminal antecedent of the petitioner, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
