The petitioner is languishing in custody since 18.08.2014 in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. It is alleged that for a petty dispute of the mobile recharge at the mobile shop of the petitioner the petitioner assaulted the informant and his son.
The injury of the informant has been found to be simple in nature, though the injuries of Ranjeet Kumar have been found to be grievous. But from the perusal of the FIR it
Patna High Court Cr.Misc. No.47384 of 2014 (02) dt.06-02-2015 2/2 appears that there was a free fight and there is counter version of the occurrence also.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Town P.S. Case No. 549 of 2014.
