The petitioner apprehends his arrest in Simri P.S. case No. 29 of 2016 under Section 307 and other Sections of the Indian Penal Code.
The petitioner is alleged to have assaulted Kamod Singh, the informant, with iron rod on his head. It is submitted that Kamod Singh got simple injury on his head. There is land dispute between the parties. Randhir Singh is alleged to have assaulted the brother of informant with Garasa but he has already been granted anticipatory bail by the learned Sessions Judge vide order dated 20.04.2016 passed in ABP No. 525 of 2016 and prayer of petitioner for anticipatory bail was rejected without any reason.
Patna High Court Cr.Misc. No.27965 of 2016 (2) dt.02-09-2016 2/2 It appears that Randhir Singh is alleged to have assaulted Santosh Singh, brother of the informant, with Garasa which hit on his ear. The case of the petitioner is almost same and similar to that of Randhir Singh.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Ravi Pandey, learned Judicial Magistrate, 1st class, Darbhanga in Simri P.S. Case No. 29 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
