JUSTICE PARTHA SARTHY ORAL ORDER 09-12-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The instant application for regular bail has been filed by the petitioner in connection with Banmankhi P.S. Case No.84 of 2019 registered under sections 8 and 20 of the NDPS Act. As per allegation in the FIR, on a raid being conducted 1.5 kg of ganja is stated to have been recovered from the house of the petitioner.

It is submitted by learned counsel for the petitioner that no recovery as alleged has taken place. He has been falsely implicated in the case as in the same F.I.R. it has been mentioned that on an earlier raid no incriminating article was recovered. The petitioner is in custody since 9.4.2020, investigation in the case has concluded and he has no criminal

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case including the petitioner being in custody since 9.4.2020, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Banmankhi P.S. Case No.84 of 2019 (Special Case No.11 of 2019) on his furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, NDPS Act, Purnea.
