This application for regular bail arises out of Manihari P.S. Case No. 390 of 2019 (S.T. No. 83 of 2020), disclosing the offence punishable under Section 307 and other allied Sections of the Indian Penal Code and Sections 25(1-b) a/26/27 of the Arms Act.

The petitioner is in custody since 16.11.2019. His prayer for regular bail was earlier rejected by an order of this Court dated 04.09.2020, passed in Cr. Misc. No. 22306 of 2020. By making this application, the petitioner has renewed his prayer for grant of regular bail.

Taking note of the petitioner's criminal antecedent and the prosecution's case that in order to get the petitioner

Patna High Court CR. MISC. No.44521 of 2021(5) dt.17-11-2021 2/2 freed from the clutches of the police, the occurrence had taken place in which the police personnel were assaulted, his prayer for bail was rejected.

For the present, no case is made out for grant of regular bail. Charges have been framed. It appears from the report sent by the learned court below that prosecution witnesses have, however, not been produced for examination. In such view of the matter, this application is dismissed with an observation that in case there is no substantial progress at the trial, the petitioner shall be at liberty to renew his prayer for bail after six months.
