JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 394 of the Indian Penal Code. One co-accused, namely, Gajo Das @ Raju Das @ Rajendra Das was caught on the spot and at that time he uttered the name of the petitioner and it appears that except the aforesaid material as well as some criminal antecedent, there is nothing against the petitioner.

No doubt, petitioner could be remanded in this case after five years but submission on behalf of the petitioner is that petitioner had gone outside the State and that was the reason he could not surrender before the court below in time.

Misc. No. 3694 of 2010, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Barhara P.S.
