The petitioners apprehend their arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per the prosecution case, 42 named accused persons, including these petitioners, and 20 unknown persons, variously armed, attacked on the informant and his family members as a result of which 10 persons sustained injuries. Learned counsel for the petitioners submits that no specific allegation has been made against these petitioners. They

Patna High Court CR. MISC. No.33711 of 2022(3) dt.24-11-2022 2/2 are only alleged to be member of the mob. Similarly situated coaccused persons have been granted anticipatory bail, vide order dated 19.07.2022 passed in Cr.Misc. No. 69579 of 2021. Petitioners have got clean antecedent.

Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Danapur, Patna in connection with Bihta PS case No. 360 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
