JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 341, 323, 324, 325, 307, 452, 379, 504/34 of the Indian Penal Code.

Petitioner is said to have given Garasa blow causing head injury to injured Rakesh Kumar.

No doubt, sharp cut injury was found on the head of injured Rakesh Kumar but the opinion regarding the aforesaid injury was kept reserved and even till the submission of charge sheet the I.O. could not succeed to collect the complete injury report of injured Rakesh Kumar.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.24609 of 2016 (3) dt.18-07-2016 2/2 well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. at Sheohar in connection with Tariyani P.S. Case No.149 of 2015.
