JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 This application, for grant of anticipatory bail, arises out of Katra P.S. Case No. 32 of 2018, disclosing offences under Sections 272 and 273 of the Indian Penal Code and Section 30(a), 36 and 38 of the Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is of recovery of 52.5 litres of liquor from the tempo and two persons were arrested and it is said that petitioner and others succeeded in fleeing away.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and nothing has been recovered from his conscious possession and he has been made accused only on the basis of suspicion.
