====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 20-08-2022 Heard learned counsel for the petitioner and learned APP for the State.

The Petitioner is in custody since 14.09.2020 in connection with Parbatta Police Station Case No. 320 of 2020 registered for offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

There is recovery of 549 liters of illicit liquor from van whose owner is petitioner.

Learned counsel for the petitioner has renewed his prayer for regular bail in the light of the order dated 13.08.2021 passed in Cr. Misc. No. 10195 of 2021 with the observation to renew his prayer for bail after nine months if the trial is not concluded and therefore, in the present case the petitioner has renewed his prayer. Considering the fact that the petitioner has three antecedents of similar nature under the Bihar Prohibition and Excise (Amendment) Act and he is in custody since 14.09.2020, he shall be released on bail after framing of charge or on completion of one year in custody whichever is earlier, on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special judge-II, Khagaria in connection with Parbatta Police Station Case No. 320 of 2020.

The petitioner will visit Parbatta Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
