JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 This application, for grant of anticipatory bail, arises out of Daudpur P.S. Case No. 188 of 2018, disclosing offences under Sections 147, 323, 324, 308, 379 and 120(B) of the Indian Penal Code.

Allegation against the petitioner and others is of assault to the informant and specific allegation against the petitioner is that he assaulted the informant on his head by means of knife.

Submission of learned counsel for the petitioner that there is case and counter case between the parties and all the injury caused to the informant has been found to be simple in nature.

Heard learned A.P.P. also.

Having heard both sides, considering the submission,

Patna High Court Cr.Misc. No.77946 of 2018(2) dt.03-01-2019 2/2 as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Chapra, Saran/ or the concerned court, where the case is pending, in connection with Daudpur P.S.
