The petitioner is apprehending his arrest in connection with Mairwa P.S.Case No.231 of 2018 , registered for offences punishable under Sections 272, 273, 308, 34 of the Indian Penal Code and Section 30, 38, 41 of the Bihar Excise Act, 2016. The police intercepted one Maruti Celario vehicle and there is recovery of 345 ltrs. 600 ml. of liquor from the vehicle and the petitioner succeeded in fleeing away from the place of occurrence.
Submission of the learned counsel for the petitioner is that nothing has been recovered from his possession, he has been named only on the basis of suspicion and the vehicle does not belong to the petitioner and he has no criminal antecedent, moreover one Satyendra Yadav who was also named in the FIR
Patna High Court Cr.Misc. No.77655 of 2018(2) dt.02-01-2019 2/2 has been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court, vide order dated 14.12.2018 passed in Cr. Misc. No.74891 of 2018.

Having heard both sides and in view of the fact that another co-accused has been granted privilege of anticipatory bail and there is no recovery from the possession of the petitioner, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II, Siwan cum Special Judge, Excise in connection with Mairwa P.S.Case No.231 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
