JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2019 This is an application for grant of anticipatory bail in connection with Maner P.S. Case No. 250 of 2018, disclosing offences under Sections 30(a), 37(b) of the Bihar Prohibition and Excise Act.

Allegation is of recovery of 12 bottles Officers' Choice liquor each containing 750 ml from a motorcycle and 30 bottles each containing 750 ml from a bag. Petitioner is named in the F.I.R.

Submission of learned counsel for the petitioner is that the recovery is from a motorcycle and bag and nothing has been recovered from the possession of the petitioner. Further, the petitioner has no criminal antecedent.

Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court Cr.Misc. No.78667 of 2018(2) dt.10-01-2019 2/2 submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna, in connection with Maner P.S.
