JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 The petitioners apprehend their arrest in connection with Darihat P.S.Case No. 121 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 . Allegation, as per the FIR is of recovery of 190 litres of country made liquor from a tempo and petitioners are named in the FIR.
Submission of learned counsel for the petitioners is that petitioners have not been arrested at the spot and nothing has been recovered from their possession and they have no criminal antecedent.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioners, abovenamed,
Patna High Court Cr.Misc. No.77923 of 2018(2) dt.03-01-2019 2/2 in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned IInd Additional District and Sessions Judge-cum-Special Judge (Excise) Rohtas at Sasaram in connection with Darihat P.S. Case No. 121 of 2017; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sujit/- U T
