Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Complaint Case No. 1481 of 2019 (Trial No. 1987 of 2022) lodged under Sections 323, 406 and 498A of the I.P.C. As per prosecution, the allegation has been made in the complaint by the complainant against the petitioner and his

Patna High Court CR. MISC. No.34094 of 2022(4) dt.16-11-2022 2/3 family members that they demanded one lac rupees and upon non-fulfillment, they have thrown the informant from the house. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that antecedent of the petitioner is clean and he is in custody since 13.04.2022. Learned counsel further submits that the alleged marriage was taken place 23 years back. Counsel has categorically stated in paragraph-9 of the petition that prior to this marriage, the informant was already married having 3 issues and she has left the house of the petitioner and started residing in Mumbai and subsequently very recently he has visited to the house of the petitioner and created undue pressure to fulfill her demand, upon non-fulfillment the present case has been filed. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Gopalganj in connection with Complaint Case No. 1481 of 2019, subject to the conditions as laid down under Section
