JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-03-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Jandaha P.S. Case No. 181 of 2014 registered under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that on the basis of the written report of informant, Chotu Kumar @ Vikash Kumar, the present case has been instituted, under Section 395 of the Indian Penal Code, against one Aslam without parentage and six others boarded in Scorpio. The petitioner has been implicated in this case as the name of the petitioner is also Aslam @ Aslam Rajavi in course of investigation. It is further submitted that informant has claimed to

Patna High Court Cr.Misc. No.48723 of 2014 (2) dt.03-03-2015 identify the culprits on seeing them again but petitioner has not been put on T.I. Parade while he is in custody since 26.07.2014. It is further submitted that in course of investigation nothing incriminating has been recovered from possession of the petitioner. While the petitioner is accused in three other cases, but in all three cases, he is on bail.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Vaishali at Hajipur, in connection with Jandaha P.S. Case No. 181 of 2014.
