Petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 302 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that all accused persons including the petitioner variously armed surrounded the husband of the informant when on the order of co-accused Niranjan Singh co-accused Ramnandan Singh fired and thereafter other accused persons including the petitioner assaulted with fists and slaps.

It is submitted by learned counsel for the petitioner that specific accusation is only levelled against Niranjan Singh and Ramnandan Singh and there is no specific accusation against the petitioner. The postmortem reflects only

Patna High Court Cr.Misc. No.6266 of 2015 (5) dt.07-05-2015 2/2 one fire arm injury which is alleged to have been caused by Ramnandan Singh. This fact has not been controverted by learned A.P.P after going through the case diary and the postmortem report.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City in connection with Fatwah P.S. Case No. 433 of 2014.
