The petitioner is an accused in connection with Dalasingsarai P.S. Case No. 12 of 2016, registered under Section 302/34 of Indian Penal Code and Section 27 of the Arms Act, pending in the Court of A.C.J.M. Dalasingsarai (Samastipur). The accusation is that 10 persons, including the petitioner, surrounded the deceased Sita Ram Choudhary and this petitioner shot fire at his chest, who died on the spot. Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case due to land dispute. The petitioner is in custody since 03.02.2016. Learned counsel for the State vehemently opposed the prayer of the petitioner and submits that there is direct allegation

Patna High Court Cr.Misc. No.25135 of 2016 (4) dt.03-08-2016 2/2 against the petitioner, who shot fire on the deceased. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected.
