Petitioners apprehend their arrest in a case registered for the offence punishable under Section 366, 376 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, petitioner No.1 along with some unknown persons kidnapped the victim and kept her confined in a room under the guard of his wife, petitioner No.2. Petitioner No.1 also committed rape with the victim and sold her to another person.
Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in
Patna High Court CR. MISC. No.34204 of 2022(2) dt.20-10-2022 2/2 the case. No such occurrence, as alleged in the FIR, has ever taken place. Petitioners have got clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that there is direct and specific allegation against these petitioners which has been fully supported by the victim in her statement u/s 164 of the Cr. P. C. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected.
