2. The learned counsel for the petitioner submits that during the pendency of this petition, the petitioner, namely Patel Virendra Sharma @ Virendra Kumar Sharma has been arrested, and, as such, he seeks permission to withdraw the instant petition.

3. It has been brought to my notice that the regular bail petition of the co-accused was disposed of by a Coordinate Bench of this Court and in the light of the directions contained in Circular Order No. 1 of 2024 dated 02.02.2024 of this Court

Patna High Court CR. MISC. No.37886 of 2024(2) dt.11-06-2024 2/2 issued pursuant to the judgment dated 19th January, 2024 of the Hon'ble Supreme Court in the case of Kusha Duruka vs. the State of Odisha, Criminal Appeal No. 303 of 2024, arising out of SLP (Crl.) No. 12301 of 2023, this matter becomes a tied up matter of the Coordinate Bench.

4. However, considering the fact that the petitioner has been arrested and withdrawal is being sought and also considering the fact that the matter has been placed before the Vacation Bench, the prayer is allowed.

5. Accordingly, this application is dismissed as withdrawn.
