====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 24-07-2023 Heard Mr. Ashok Kumar Jha, learned counsel for the petitioner and learned APP for the State.

2. The Petitioner is apprehending her arrest in connection with Suppi P.S. Case No.324 of 2022, registered for the offences punishable under Sections 420, 467, 468, 471, 120B of the Indian Penal Code.

3. Allegedly, the petitioner has obtained her appointment on the post of Panchayat Teacher on the basis of forged TET certificate.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner herself is a victim of the

Patna High Court CR. MISC. No.34248 of 2023(3) dt.24-07-2023 2/3 circumstances and at the time of appointment, her entire certificate was examined but no infirmity has been found. He further submits that pursuant to the direction of this Court in C.W.J.C. No. 15459 of 2014, she has been removed from her service way back in the year 2015 itself and as such she has already been appropriately punished.

5. On the other hand learned APP for the State vehemently opposes the bail application and submits that there are ample materials on record and her complicity cannot be denied.

6. Regard being had to the submissions made on behalf of the parties and considering the fact that the service of the petitioner has already been terminated way back in the year 2015 itself, apart from the fact that she is a lady having fair antecedent, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-I- Class, Sitamarhi in connection with Suppi P.S. Case No.324 of 2022, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with
