The petitioner seeks bail in a case registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The FIR of the occurrence of murder is against unknown. Petitioner is in custody since 29.10.2018. Name of the petitioner surfaced only on the basis of confessional statement of co-accused before the police.
It has been submitted on behalf of the petitioner that the petitioner there is no T.I.P. against the petitioner. Charge sheet has been submitted in this case. The other co-accused has been granted bail by this Coordinate Bench of this Hon'ble Court in Cr. Misc. No. 32755 of 2019 dated 17.05.2019.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after framing of the
Patna High Court CR. MISC. No. 32493 of 2019(3) dt.28-08-2019 2/2 charge on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Patna City, Patna, in connection with Bahadurpur P.S. Case No. 304/2018, subject to the following conditions:
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by Court and his absence on two consecutive dates without sufficient reasons, his bail bond shall be cancelled by the court below.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner. Accordingly, this application is disposed of. (Anjani Kumar Sharan, J) amitkumar/- U T
