JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-01-2021 Heard learned counsel for the petitioner and learned Senior Counsel appearing on behalf of the informant as well as learned Additional Public Prosecutor for the State. The petitioner is in custody since 01.08.2019 in connection with Bagaha (Patkhauli) P.S. Case No. 164/2018 registered for the offences punishable under Sections 420/406/467/468/471 of the Indian Penal Code. Earlier the bail application of this petitioner was rejected vide order dated 10.12.2019.
Vide order dated 07.12.2020, a report was called for from the Court of learned Additional Chief Judicial Magistrate 1st, Bagaha, West Champaran, with regard to present stage of trial in connection with Bagaha (Patkhauli) P.S. Case No. 164/2018 which is kept at Flag 'A'.

No.32790 of 2020(3) dt.19-01-2021 2/2 It appears from the Report dated 11.12.2020 that out of 12 witness, nine witnesses have already been examined and case is likely to be concluded within a period of one month. Considering the period of custody and the stage of trial, the bail petition of the petitioner is allowed. Let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate 1st, Bagaha, West Champaran in connection with Bagaha (Patkhauli) P.S. Case No. 164/2018, subject to following conditions:- (1)Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court on his absence on two consecutive dates without sufficient reason, his bail-bonds shall be cancelled by the Court below.
(2) If the petitioner tempers with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail.
