JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 This is an application for grant of anticipatory bail in connection with Parbatta P.S. Case No. 222 of 2018, G.R. No. 1672/2018 disclosing offences under Sections 451, 376, 379 of the Indian Penal Code and Section 12 of the POCSO Act. Allegation against the petitioner is that he entered into the house of the informant and on the point of pistol he committed rape upon the daughter of the informant. Submission of learned counsel for the petitioner is that the medical report does not support the prosecution case and due to dispute the petitioner has falsely been implicated in this case.
Heard learned A.P.P. also, who opposed the prayer for anticipatory bail of the petitioner stating that there is specific allegation of commission of rape upon the daughter of the
Patna High Court Cr.Misc. No.77874 of 2018(2) dt.03-01-2019 2/2 informant against the petitioner.
Having heard both sides, considering the above submission, I am not inclined to grant privilege of anticipatory bail to the petitioner.
Accordingly, this application is dismissed.
