This is a petition for grant of regular bail in a case under Sections 121, 121(A), 120B of the Indian Penal Code and Sections 10, 11, 13, 17, 18, 18(A), 18(B), 19 and 20 of the Prevention of Unlawful Activities Act.

It is alleged that Naxal literature, banner, poster, wall writing and detonator etc. were recovered from the clinic of the petitioner.

Learned counsel for the petitioner submits that in the case diary there is no mention of any expert opinion regarding recovery of detonator and the petitioner is in jail custody since 24.11.2014.

Hence, having regard to the facts and circumstances

Patna High Court Cr.Misc. No.18087 of 2015 (8) dt.31-07-2015 of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Motipur P. S. Case No. 401 of 2014, subject to the condition that the petitioner shall not involve in such type of activity in future and any involvement of the petitioner shall be a ground for cancellation of bail bond of the petitioner.
