The petitioner seeks bail in a case under section 420 and other sections of the IPC.

The informant alleged that he received complaint about nondistribution of the amount meant for students of the school and on such complaint, made enquiry and found that the petitioner has embezzled the government money to the tune of Rs.1,69,800/-, which was recovered from the possession of the petitioner.

It is submitted that the petitioner is Head Master of the school. The B.D.O. is not authorised for raiding. The petitioner did not defalcate any amount.

Considering the facts, nature of allegation and also the fact that the petitioner is in jail for the last two months, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Siwan in connection with Ziradei P.S.Case no.05 of 2015.
