Mr. Md. Aslam Ansari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 12-09-2022 Vide order dated 01.08.2022, the petition of petitioners no.1, 2 and 5 have already been dismissed as withdrawn.

Heard learned counsel for the petitioners no.3, 4, 6 and 7 and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 342, 323, 324, 307, 386, 332, 333, 427, 353, 504 and 506 of the Indian Penal Code and Section 3 of the Epidemic Act

Patna High Court CR. MISC. No.33506 of 2022(3) dt.12-09-2022 2/2 and Sections 3/ 4 of the Damage to Property Act. It is a case of blocking the road after the death of one person, namely, Kishore Das in a road accident. It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that they were only members of the mob and petitioners have clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioners, namely, Surendra Das, Umrawati Devi, Anish Kumar and Manish Kumar, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran at Motihari in connection with Sugauli P.S. Case No. 48 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
