JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-01-2019 Petitioner apprehends his arrest in connection with Naugachia Mahila P.S.Case No. 54 of 2018 registered for the offences punishable under Sections 354A, 509, 506/34 of the Indian Penal Code and Section 66(E) of I.T. Act. Allegation as per FIR is that obscene photograph of the daughter of the informant was made viral by one Subham Choudhary and it is transpired that petitioner has also hand in that.
Submission of learned counsel for the petitioner is that he is nephew of the informant and only on suspicion he has been made accused in this case and allegation is against Subham Choudhary, who has sent the photograph in face book. Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.77613 of 2018(2) dt.02-01-2019 2/2 circumstances, let petitioner, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Naugachia Mahila P.S.Case No. 54 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
