The petitioner seeks bail in Ahiyapur P.S. Case No. 609 of 2012 dated 10.11.2012 instituted under Section 366(A)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that though he is named in the First Information Report but it is the other coaccused namely Laloo Sahani, who was in love with the girl and with whom she had gone away. It is submitted that the girl in her statement before the Court under Section 164 of the Code of Criminal Procedure, 1973 has stated such fact and she has also stated that her age was 18 years and the Court has also assessed it to be 20 years. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in Ahiyapur P.S.
