In this case, the petitioners are apprehending their arrest in connection with Fatehpur (Gurpa O.P.) P.S. Case No. 321 of 2018 registered for offences under sections 304(B)/34 of the Indian Penal Code.

From the First Information Report, it appears that the marriage of the deceased daughter of the Informant was solemnized with Manish Yadav in the year 2011 and she has been killed and thrown in the railway track. The body was lifted and brought to the hospital.

An allegation has been made in the complaint petition that the incident has taken place on account of non-

Patna High Court CR. MISC. No.31461 of 2019(2) dt.13-05-2019 2/2 fulfillment of the demand of motorcycle by the husband. Learned counsel for the petitioners submits that petitioner no.1 is the Gotni whereas petitioner no.2 is the Dewar having no connection with the alleged incident as they have a separate mess and business.

Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Xth, Gaya in connection with Fatehpur (Gurpa O.P.) P.S. Case No. 321 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
