JUSTICE AMARESH KUMAR LAL ORAL ORDER 26-02-2015 Heard the learned counsel for the petitioners and learned A.P.P. for the State.
The petitioners are in custody since 28.11.2014 in a case registered for the offence punishable under Sections 147, 148, 149, 323, 307/34 and 504 of the Indian Penal Code. It is submitted that there has been fight between both the parties for fishing right and the petitioner no. 1 has also lodged Barhariya P.S. Case No. 431 of 2014 for the offence punishable under Sections 324, 308 and other allied Sections of the Indian Penal Code.
There is no specific allegation of overt act against the petitioners. The petitioners have no criminal antecedents.
Patna High Court Cr.Misc. No.7026 of 2015 (2) dt.26-02-2015 Considering the facts and circumstances of this case, the above-named petitioners are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Barhariya Police Station Case No. 432 of 2014 with the following conditions:
1. One of the bailors will be the close relative of the petitioners.
2. The petitioners will not indulge in similar or in any other offence.
3. The petitioners will be well represented in the court.
4. In case of absence for two consecutive dates or in violation of the terms of the bail, their bail bonds will be liable to be cancelled by the court concerned. (Amaresh Kumar Lal, J.) Vats/- U T
