The petitioner is custody since 03.12.2014 in connection with Parbatta P.S. Case No. 232/14 registered for the offences punishable under Section 302/34 of the Indian Penal Code. Learned counsel for the petitioner submits that as per the First Information Report, four persons has been named as accused who are alleged to have assaulted the father of the informant Makhan Mandal who died of the said injury. Learned counsel for the petitioner submits that other similarly situated persons have been extended the benefit of regular bail vide order dated 09.03.2015 passed in Cr. Misc. No. 10298 of 2015 and also Cr. Misc. No. 13941 of 2015 vide order dated 23.04.2015. It is
Patna High Court Cr.Misc. No.12359 of 2015 (3) dt.27-05-2015 submitted that the petitioner's case stands on the similar footing and, therefore, he may be granted privilege of regular bail. Considering the period of custody and also the fact that the petitioner's case is similarly situated to those who have already been granted bail and has no criminal antecedent, let the petitioner Suman Kumar be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Khagaria in connection with Parabatta P.S.
