JUSTICE PURNENDU SINGH ORAL ORDER 17-08-2022 Heard Mr. Saurav Singh, learned counsel for the petitioner and Mr. Ajay Kumar Jha, learned APP for the State. The present modification application filed under Section 482 of the Code of Criminal Procedure is for modification of the order dated 29.10.2021 passed in Cr. Misc. No. 39324 of 2020 wherein prayer is for extension of time to furnish bail bonds.

Learned counsel appearing on behalf of the petitioner submits that the petitioner could not surrender before the court below because he was undergoing treatment for liver Cirrhosis and kidney problem at different hospitals in the State and to that effect the petitioner has made specific statement in Paragraph Nos. 4, 5 and 8 of the modification application. The

Patna High Court CR. MISC. No.36407 of 2022(2) dt.17-08-2022 2/2 prescriptions are on record along with the discharge summary. Considering the submissions made on behalf of the petitioner and statements made in Paragraph Nos. 4, 5 and 8, the order dated 29.10.2021 passed in Cr. Misc. No. 39324 of 2020 is modified to the extent that further two weeks time is extended to the petitioner to surrender before the court below from today. The other conditions imposed vide order dated 29.10.2021 shall remain effective.

Accordingly, the present modification application stands disposed of.
