JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-03-2015 Petitioner is languishing in custody since 13.08.2014 in a case registered for the offences punishable under Sections 25(1-B)a, 26(i), 35 of the Arms Act and Sections 18/21 of The Unlawful Activities(Prevention) Act. The raid was laid in the house of the petitioner when from the possession of the petitioner automatic country made pistol, SIM cards, mobile and other articles were recovered. Similar was the recovery from two other persons who were also present in the house of the petitioner. It is submitted by learned counsel for the petitioner that though case was registered also under Sections 18/21 of the Unlawful Activities(Prevention) Act but chargesheet was submitted under Sections 25(1-B)a, 26(i), 35 of the Arms Act and Section 66C of the Information Technology Act and consequently cognizance was also taken under the

Patna High Court Cr.Misc. No.11338 of 2015 (2) dt.27-03-2015 2/2 aforesaid provisions of the Indian Penal Code which gets reflected from the order dated 17.12.2014 passed by learned Chief Judicial Magistrate, Patna. The certified copy of the same has been produced. Let it be kept on record.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the period under custody, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with A.T.S. P.S. Case No. 1 of 2014.
